AustinApartmentBuildings.com is an independent reference directory of the 197 largest apartment buildings in Austin, each with at least 324 homes. It is created and maintained by ChicagoRealEstate.ai. This directory supports equal housing opportunity.
Equal Housing Opportunity
It is unlawful to discriminate in the sale, rental, financing or advertising of housing on the basis of a protected characteristic. Federal and Texas law both apply to housing in Austin, and the City of Austin adds protections of its own.
Federal law. The federal Fair Housing Act prohibits housing discrimination because of race, color, national origin, religion, sex, familial status or disability. It is enforced by the U.S. Department of Housing and Urban Development (HUD).
Texas law. The Texas Fair Housing Act (Texas Property Code, Chapter 301) protects the same characteristics: race, color, national origin, religion, sex, familial status and disability. It is administered by the Civil Rights Division of the Texas Workforce Commission.
City of Austin. The Civil Rights Division of the City of Austin’s Civil Rights Office accepts fair housing complaints based on race, color, religion, sex (including gender identity and sexual orientation), familial status, national origin and disability, and, under City of Austin ordinance, on creed, student status, marital status, age or source of income. The City states that the Division operates as a Fair Housing Assistance Program.
State law limits what a Texas city can require on source of income. Texas Local Government Code Section 250.007 provides that a Texas city or county generally may not adopt or enforce an ordinance that prohibits a landlord from refusing to rent to a person because that person’s lawful source of income to pay rent includes funding from a federal housing assistance program. Whether a particular building or situation is covered by the City’s protections is a question for the City’s Civil Rights Office or a lawyer, not for this directory. City ordinances apply only inside the City of Austin’s limits, and an Austin mailing address does not by itself establish that a building is inside them.
How This Directory Is Written
This directory describes buildings, not the people who live in them. Listings record building characteristics such as unit counts, number of floors, year built, amenities, parking and pet policies. This site does not publish tenant preferences or limitations. It does not rank buildings, and it does not accept payment for inclusion or position. Where a field is blank, the information was not confirmed from a reliable source; a blank field is not a statement about the building.
Income-Restricted and Age-Restricted Buildings
Some apartment buildings operate under affordable housing programs, such as the federal Low-Income Housing Tax Credit or HUD-assisted housing, which limit eligibility by household income. Income limits under these programs are generally set as a percentage of area median income and are updated annually; this directory does not publish them.
Some buildings operate as housing for older persons. Under federal fair housing rules, housing qualifies for the “55 and older” exemption from the familial status protections only if at least 80 percent of its occupied units are occupied by at least one person 55 years of age or older, and the housing publishes and adheres to policies and procedures that demonstrate its intent to operate as housing for persons 55 or older. Housing intended for and solely occupied by persons 62 or older is also exempt.
Nothing on this site is a determination that any person is or is not eligible for any building. Contact the building directly for current eligibility requirements.
